Pension Sharing or Earmarking?

Pension Sharing would favour me whereas Earmarking favours my ex.

Once we commence with the legals I am assuming our respective Solicitors would seek to resolve this between us but failing this the matter in due course would be determined by the court?

Am I correct here?

    Hmm, what makes you say that? Pension sharing is (IMO) generally more sensible because it makes for a clean break (or in a final salary scheme, much more of one), which is typically what the ex-spouse would prefer.

    Hi and thank you and that's my point.

    Pension sharing favours me rather than Earmarking because I plan to re-marry. Under the rules of the scheme, once I do so it would affect my entitlement as noted below .....

    If the order is for a regular payment of a pension, the payments will stop if your former spouse/civil partner should marry or enter into a civil partnership in the future. (Note, your former spouse/civil partner’s right to a lump sum under earmarking does not stop on remarriage but the earmarking order will stop if your former spouse/civil partner dies before you.)

    What I am trying to establish is HOW is the decision (Sharing or Earmarking) made? Is it broadly as my original post?
