No Planning Permission or Building Control: cash offers only

Not really a mortgage query as such but some people are so knowledgeable about other aspects of the law that i though it might be a good idea to ask here as well:

I am looking at a really cheap property which says that it has not got planning permission or building control. They are only willing to take cash offers. Could this be a problem? I haven't had a word with the estate agent yet but i will check with them soon.

I'm just worried that i would have push back from the council and may get into trouble if i buy this house.

Anyone had experience with this kind of thing?

  • Wow! I have heard of/ seen properties that have had extensions or loft conversions done without the necessary building regs/planning permission but never a whole property!!

    I daresay that there are indemnities you can buy a to cover the financial aspect if it comes to the worst, but in all honesty I'd steer a million miles clear of a property like this.

    I would work out how much money you can afford to throw away - A

    Then find out how much it would cost to pull it down and clear up the mess - B

    Then work out the cost of buying the property - legal fees, survey, stamp duty etc - C


    Then offer an amount equal to A minus B minus C.


    You must assume that the reason the property has no planning permission or building regulations sign off is that the vendor is unable to get it. If they could, the cost of doing so would be just a fraction of the increase in value - so why would anybody in their right mind not do so.

    They are looking for a fall guy.

    And what exactly is missing in the way of consents? Does it have permission for residential use, for example? Were consents issued for something only slightly different from what has been built? How feasible is it to demolish and rebuild something after getting new consents, if necessary? Has there already been correspondence with the council or enforcement action or an aggrieved neighbour?
