State Pension Claim Form & Separated from Husband

    The only thing that puzzles me now then is why they need to know my husband's details on this form when it has no effect on how much I receive myself?

    Because he can claim a pension worth 60% of yours if it's more than he's entitled to himself.

    Does it really matter what he can claim, I'm sure if you could claim a bigger pension based on his contributions you would. It's the tax payer who loses out not you but perfectly legal.

    In that case, you should have divorced him and cut all legal ties.

    ...I would presume they require those details if you had insufficient NI credits to qualify for a State pension in your own right -its a generic form and some wives/husbands claiming will be dependent on their OH 's contributions for the partial pension.

    I completely agree. If you got run over by a bus tomorrow (or given the weather hit on t he head with a tree branch) he would get everything you have.

    Do you want that?

    Get a divorce, make a will. Do something. Do you have a private pension?

    Texet, I am in the same position as you, separated, not divorced. It is vital to make a will, so that your money goes where you want it to at your death.

    As I understand it divorce makes no difference, You can still claim on a divorced spouse's NI contributions in respect of the years you were married.

    So if they had divorced years ago when they separated, he would only have been able to claim for the years of the marriage whereas he's now had the benefit of all her NI contributions (if he really has claimed a pension by that means).

    He also wouldn't be entitled to inherit from her if she dies intestate.

    He would not be able to do this until they both reach state pension age, which it sounds like the OP has not done yet (unless she has deferred).
