Sangie595, wrong again. The employer IS short staffed. At the moment my team do volunteered (guilt-tripped) overtime. Which I never go for as per the reasons above. If everyone were to do their regular hours, the business couldn't exist sufficiently.

None of which you mentioned earlier. So it is disingenuous to mention it now simply because you want to show how wrong I am because you don't like the advice.

You don't do overtime. That is your right. So what? I am not defending the employer or telling you it is a great job - but if the business didn't exist then you wouldn't have a job and neither would anyone else. You've said it yourself - it was the only offer you got and you were desperate to get a job; and you are desperate to keep that job until something else comes along, which so far it hasn't. That isn't a judgement. It is a simple fact. If you don't care about any of that, then you are free to do as you like and take the risk. But if the employer decides that you are more trouble than you are worth, then you have no cause for complaint. Like it or not, these are the hours and this is the job you agreed to. You were always in a position to either find out exactly what the terms were instead of assuming them (and it may be a hard lesson, but I bet you won't ever do that again), or to walk when you found them out. And nobody is forcing you to stay now.

So by all means try to renegotiate your hours. But if you start using red herrings about your health or caring responsibilities, be prepared for fallout. I am sure everyone would like better hours of work. You say they do. But that doesn't mean they will get them, and it doesn't mean you will get them either.

If you don't consider yourself as having a disability why mention depression and migraine?

Until recently I worked six days a week (every week) with a severely disabled wife and two young (and rather bonkers) children, one who is also disabled.

You say your not sure if you receive NMW, are you not able to simply divide your pay by hours worked before deductions over a yearly basis?

What skills and qualifications do you have? Most of your caring duties from your list above are basic household tasks everyone has to undertake, so why not look at some evening courses at a local college that interest you, they could also help with your employability.
  • I think you must talk about this to your senior, they can provide you the best solution for your query.

Your company may not pay sick pay but the DWP does. If you can get signed off work you can claim Employment and Support Allowance

Just to add to this, an employer cannot refuse to pay statutory sick pay if you meet the eligibility criteria. They can only refuse to pay any additional sick pay.

If eligible for statutory sick pay, you wouldn't get employment and support allowance.
