update here:
hearing granted for march
solicitors of the claimant have sent letter stating that they will oppose this
however if we pay debt and settle it that they do not want to oppose it ...
so if i do this then attend court and they dont oppose the set aside will the judge grant it or is he just more likely to or will he still just say no even without any opposition??
thank you all again for your knowledge
The court will consider all the information put before it, and decide weather to grant the set aside or not, based on points of law and if you have made the application within a "reasonable timeframe".

The county court is a profit driven business.
They will gladly take your money and grant a set aside hearing.
Will it work, I doubt it.I do Contracts, all day every day.0 -
your grounds and timing for having the ccj set aside are very poor. dont think I would risk any form of contested hearing in your shoes as you may find yourself stuck with the ccj, and costs, and still the debt.Still rolling rolling rolling......
