Urgent help needed - CapQuest

CapQuest bought my debt (£2516) from Solutions Finance in July. In August they agreed that I could pay £10 per month (I was paying the other company £5). That month I had car tax, MOT and repairs to do, so I could only afford £5. I did intend to send another £5 when I got some mystery shopping money, but forgot.

Someone calls and says I missed 2 payments. Technically it was only half of one payment. He says because I missed the payments I now have to pay the balance in full or they will take legal action. Then he offers me a settlement figure of £1910.

I have not missed one single payment to the first company in the year that I had the arrangement with them. CapQuest are speaking to me as though I have never paid anything at all. The guy says he will be there till 9pm and will put my account on hold until then.

I offered to send the additional £5 right away and he says I can't do that.

Please tell me what to say or do?

  • Just send the £5, they told us we have defaulted 5 times which we havn't every letter/phone call has the same threat. Every response yeah right whatever I've heard it all before.

    C(R)apquest will try ANYTHING to get more money out of you. Just KEEP sending the agreed payments, after all they are getting twice as much as the previous DCA.
    In the UNLIKELY event that they were to take you to court for the full figure, you are most unlikely to be ordered to pay it all off in one go, especially as you have demonstrated your commitment to the debt by offering to pay £10 a month.
    Just keep paying what you can - NO-ONE, not even Capquest, can force you to pay more than you can afford to pay.

    Egg sold my debt to CapQuest, I had some dealings with them and they were pretty brutal. For some strange reason my Egg debt is now with ARC, didn't receive any correspondence, just a phone call on my mobile and they quoted an address I'd lived at in 2003!!

    I don't think any of these places know what they're doing to be honest. I agree with the others, just send them the £5, as long as you're paying them something they can't really do much. Don't let it stress you out. :)

    Rog is right.

    if they kick up remind them that under OFT Guidelines they are not allowed to pressure you to pay more than you can afford. If necessary, we will give you the info.

    Also, if they keep ringing and you have paid, then you can write and require them to deal with you in writing only.

    And, please, set up a standing order (not a DD) to pay the £10 per month, so you are OK in future.

    Could you set up a standing order so that it goes out and you have evidence - I pay via standing order with them.
  • Any collection agency would rather have £5.00 than nothing so be pesistent in your approach. Be honest and continue to repeatidly tell them your circumstances. When they realise that you simply 'can not' as opposed to 'will not' pay, they should acknowledge your repayment plan again. The problem usually arises when you dont warn them in advance that you might not be able to make this months payment... some are more abrupt than others but they all have to answer to the FOS if customers feel agrieved by their methods.
