Help with debt that isn't mine!

I need help with a debt that is on my credit file but is not mine.

The default is recorded by Lowels and is a Mobil phone contract.

I have never owned this contact and told Lowels as such. They investigated and declared they were satisfied the debt was mine as payments had been made. However I did not have a bank account at this time and so the payments were not made by me. Lowels cannot tell me who the payments were made by and have been unable to provide anything showing this debt to be mine. They are no longer chasing me for repayment however they refuse to remove it from my credit report. I informed the credit reference agency of this and they replied stating Lowels have refused to remove the entry as they state it is correct! My credit history is perfect except for this and it's hugely affecting me, please tell me what I can do. It's unfair that I am being punished for a debt that is not mine!

    Formal complaint again, stating that if not removed you will be reporting them to the ICO for breach of the Data Protection Act, and may consider court action against Lowell to enforce removal and compensation.

    In writing recorded post to Sara de Tute who is their compliance director, and CC'd by email to ComplaintsResolution@LowellGroup.co.uk

    State that you will also be contacting things like BBC watchdog and Newspaper money columns/editors about Lowells refusal to remove this.

    May also be worth making a formal complaint to the mobile company and then their ombudsman if they were the ones who originally recorded the default, and Lowells just took it over, rather than being a mistrace by Lowellls.

    I will contact them again. They just started ignoring my letters so I thought it was all dealt with. This is so frustrating!

    As Fermi says, you need to head your letter "COMPLAINT" and send to there compliance director.


    Lowell are a big organisation with many satellite companies, you need to communicate with the right people here, and it should get resolved.
    Ask for compensation also !!
