Terms and conditions
This prize draw is open to residents of the UK, Channel Islands
and Isle of Man aged 18 years or over, except employees of
Telegraph Media Group Limited and its group companies
(“Promoter”), and BMW (UK) Ltd (“BMW”),
their families, agents or anyone else professionally
associated with the draw.
2. Details of how to enter form part of the terms and conditions.
It is a condition of entry that all rules are accepted as final
and that the competitor agrees to abide by these rules.
The decision of the judges is final and no correspondence will be entered into.

3. Entries must be submitted via
www.telegraph.co.uk/bmwi
and entry is restricted to one per person.
Once submitted,
entries cannot be amended in any way.

4. Late, illegible, incomplete, defaced or corrupt entries or
entries sent through agencies and third parties will not be accepted.
No responsibility can be accepted for lost entries and proof of
despatch will not be accepted as proof of receipt.
One winner will be drawn at random from all entries
received by the closing date.
The winner’s name and county can be obtained by
sending a sae to BMW – Scarlett Hotel Prize Draw Winner,
SPARK, Telegraph Media Group, 111 Buckingham Palace Road,
London SW1W 0DT within
one month after the closing date of the prize draw.

5. All entries must be received by midnight on
Sunday, February 28, 2016.

6. The winner will be contacted within 14 days of
the closing date of the prize draw.
Should the Promoter be unable to contact the winner
or should the winner be unable to accept the prize,
the Promoter reserves the right to award the prize to
an alternative winner,
drawn in accordance with these terms and conditions.
7. The prize as described is available on the date of publication.
Should the prize become unavailable,
a substitute of equal value shall be provided.

8. The winning entrant will win a
seven-night holiday for two in the Scarlett Hotel,
Cornwall and the use of a BMWi or Plug-in hybrid car
for the duration of the prize.
The prize package comprises:
• Seven nights accommodation in the 4-star Scarlett Hotel, Cornwall;
• Breakfast and dinner in the hotel’s restaurant on each day;
• Champagne afternoon tea fro two on one day;
• A Scarlett Journey Spa Package for two;
• Two classes each for the winner and their guest of the winner’s choice from the Scarlett Hotel’s list of classes;
and
• The use of a BMWi or Plug-in Hybrid car throughout the stay.

9. The prize must be taken as one package.
10. Provision of the model of BMW car will be dependent on
availability and suitability at BMW’s sole discretion.
The winner may choose to have the car delivered to their
home or the hotel.
The named driver must be aged 25 years or older
and hold a full UK/EEA licence for a minimum of
2 years with no serious convictions and no more than
six points on the licence.
The named driver must provide the driving licence upon request,
in advance of the vehicle loan.
11. The BMW vehicle will be provided on a loan basis.
The loan of the BMW vehicle is subject to a separate
loan agreement and the BMW Loan Car Terms.
The named driver must agree to these terms
before taking possession of the vehicle.

The car may only be driven by:
• the named driver;
• only for private use excluding commuting and travelling
sales and not for any form of racing.
The winner is responsible for:
• any fines, congestion or other charges arising
from use of the car and for any damage arising
from their failure to take reasonable care.
The car is insured subject to an insurance excess of:
• £500 for each and every claim under £5,000;
• £1,000 for each and every claim in excess of £5,000.
Please note these excesses are in addition to any amount
payable as a result of misfuelling and / or engine
damage due to navigating through flooded areas.
For clarity in such instances an additional excess to the
value of 10% of the repair costs will be charged.
Insurance does not cover personal belongings.
BMW has the right to refuse permission to drive if driving offences/disqualifications have occurred or if
BMW UK otherwise considers driver is unfit to drive.
12. The prize does not include travel,
travel insurance, food and drink,
personal expenditure or incidental costs,
other than where mentioned.
13. The prize is valid for travel for one year from the
date of the winner being notified and excludes the
Christmas and New Year’s period, Valentine’s Day,
Easter, school and bank holidays.
Once confirmed,
the booking cannot be amended.
The winner and their guest must travel together at all times.
14. All elements of the prize are subject to availability,
non transferable and there are no cash alternatives.
15. The winner may be required to participate in
reasonable publicity on behalf of the Promoter and BMW.
16. Entrants’ data will be used for the purpose of
administration of this prize draw and in accordance
with the permissions granted or withheld at the point of entry.
17. Events may occur that render the prize draw itself
or the awarding of the prize impossible due to reasons
beyond the control of the Promoter and accordingly the
Promoter may at its absolute discretion vary or amend
the promotion and the entrant agrees that no liability
shall attach to the Promoter as a result thereof.
18. The Telegraph is responsible for the first part of the promotion,
which is the publication and adjudication of the prize draw.
Provision of the hotel stay is the responsibility of NDL Group.
BMW is responsible for providing the car.
