The landlord is liable for the Council Tax, your AST is incorrectly worded, you cannot be liable for CT. However you may find your AST is not renewed if you don't reimburse him, so you may want to consider your options.

It is badly worded however I suspect the intention was for the landlord to get the tenants to pay for any council tax charge which is due (irrespective of their actual liability under council tax legislation). The tenancy agreement doesn't allow for the specific usage of the word 'liability' in council tax.

If the landlord wants to he can take you to the small claims court and argue that the contract was intended to mean that the tenants were meant to be paying any council tax due - that would be down to a judge to then decide how it was meant. It wouldn't alter the legal council tax liability but it could mean that you have to reimburse the landlord (if the court found in his favour).
