Annual holiday entitlement at work

Hello. I have been working for current employer since July 2014. Usually were only allowed to take annual leave from March to the end of October. Because I started working part way through the year they allowed me 5 days off in November 2014. This year I have taken 4 weeks spread across the year. What my question is since I will be given my 4 weeks holidays for 2016 to take from March 2016 - have I already accrued these days of annual leave or not? I want to hand my notice in in the next few days as I am moving to a new town with my partner who's just got a decent job. Would I be able to use 2016's lot of holidays as notice? 4 weeks I believe I have to give and work. Thanks in advance :-)

When does your holiday year start and end, is it from March to February? How much days holiday do you get and how much have you had? The minimum is 28 days. You accrue the holidays for next year in the next year so no you can't use them now.

  • can take our holidays between March and the end of October. We're not allowed to take any during winter. We get 28 days holiday a year. I've already taken 28 days this year as they have to be used up by the end of October. Anyway, you've answered my question. Looks like I'm staying behind to work this notice!

  • You may actually find you will owe annual leave back to your employer aswell which they may deduct from your final pay. If your leave year runs from March onwards and they give you 28 days for the full year, if you leave say St the end of December then you only have actually accrued 21 days up to that point so would owe the company 7 days if you've already taken your full years entitlement, irrespective of the fact they don't allow you to take any leave after October. You need to check your contracf carefully.
