I over into my partners property 2 years ago he previously had a debt with Yorkshire water k
I'm mnot on the tenancy and the benefits are in my name with my partner as my carer the citizens advice told me they can't take money out of my benefits without my consent I said I DONT give consent.. I received a letter today saying the benefits are taking £26.80 per week out of my benefits which will leave me with no money to eat can anyone help plz

Who is taking money from your benefits ?
If the debt is not in your name, they cannot do that.

I'm on ESA I get £260 every two weeks the tenancy for the property I live in is for my partner and his ex the name on the water account is my partners the council are taking money from my benefits for rent arrears even though I'm not on the tenancy . Yorkshire water are taking money out of my benefits and the account isn't in my name and eon and the council have capped my gas because my partner and his ex have a debt0

I don't know the rules and regulations for deductions from your benefits for debts relating to the property. However, even if you sort that out you need to find out what's going on with these priority bills to ensure you continue to have a roof over your head.
As you live there I assume you pay rent to the tenant (your partner). I also assume, as there are all these priority debts (housing, utilties etc), the named tenant is not paying them directly. Wouldn't you be better off to negotiate with the tenant that you pay the bills/debts directly rather than pay him/her? At least that way you would know the roof over your head is secure. If rent isn't paid the house the end result will be eviction - no two ways about it.
If you don't pay rent, then perhaps that's part of the reason the debts are mounting up.

I'm still struggling for information here, there must of been paperwork related to this surely ?
I suggest you get yourself down to the council customer service centre at the town hall (I know Brid well) then wait to see someone and get a full explanation of that's happening here. (Late afternoon is quietest).
You should also tell them you are struggling to make these payments, and you are not the person named with the arrears. I too don't know the legality of what the council are doing, but they should be able to tell you.
As regards the Yorkshire water debt, the only way they can make deductions from benefits is by court order, you must of been aware of this ? You would of had the opportunity to forward your income/expenditure etc so the court could set a payment.
If you need to change the amount you pay, you need to fill in form N245, and return to the court.

Sorry Gltopps but not sure what you mean. Has the gas meter been completely disconnected? Or, have we fitted a prepayment meter? Gas disconnections are very much a last resort. Usually, where debt's involved, we'll fit a prepayment meter and put the debt on there to collect at a set amount each week.
If you let me have a bit more information, I'll do my best to give you some more meaningful advice about the gas.
