Capital Resolve

Hi guys, it's been a long time since I've been on here as things have been much improved of late :j

Quick question.....last week I received a letter from Capital Resolve. It was very basic and all it said was 'we have been passed on your details from a credit referencing agency and are contacting you about a debt matter. Please phone us on xxx before 1st December'

I have a couple of issues with this...

1. I didn't think CRA's were allowed to pass on details (and I'm not on the 'open' electrol register, voting only)?
2. I was discharged from a DRO last year and have managed my finances really well ever since. I haven't taken on any debt and I'm up to date with everything, nothing outstanding on anything.

Today I have had an email from them, again no details just a 'contact us'. I have no idea where they have got my email address from.

My first instinct is to ignore, as I KNOW I have no debt, but part of me wants to phone them and tell them to bog off and remove me from the system but I can't be bothered with the arguments.

WWYD? Ignore or contact??

    Contact them, in writing, with a provit letter, they may not be aware you had a DRO.
    Could be an old debt from those days, best to find out, but don't phone them.

    Thanks sourcrates but I have no idea what they have to prove, they give no details as to what/who the 'debt' is supposed to be with?

    The letter (see link below) puts the onus on Capital Resolve to provide some meaningful evidence that a debt is in fact owed by you. If they fail to do so, but continue to badger you regardless, you may have grounds for complaint.

    Re: the credit reference agency - they will not have "passed on" your details as such - it's more a case of Capital Resolve being entitled to look at your report to establish your whereabouts if they are attempting to recover a legitimate debt.


    If it turns out that this was a debt listed in your Debt Relief Order, you can refer CR to the Insolvency Service so they can hear it from the horse's mouth.

    Thank you for that Dennis. I have looked at the template, which I fully intended to use, but the problem is that this company haven't provided ANY of the details that I'm supposed to make reference to.

    Please don't think I am being difficult, I'm not. After spending much of my adult life hiding from creditors I have finally got to a debt-free existence and have every intention of nipping this is the bud but neither the letter, nor indeed the email, made any reference to who the debt was supposed to be with, an amount or a reference number. It literally just said that they had been 'given' my address by 'a credit reference agency' (no mention which one, if that's at all relevant) and I am to call them before the 1st December.

    Am I able to write to them and say something along the lines of....'I understand you have been attempting contact me however, since I was discharged from a DRO in 2014 (which included all previous creditors), I have no outstanding debt, nor have I taken any credit. Since you have provided me with no details of the 'debt' I am unable to assist you any further'?

    I thought these days were over :(

    yes, you could send that, it will either make them put up, or shut up.

    You have received what they call a fishing letter, usually when details of a debt are scarce, they letter bomb a number of people with similar details, in the hope of a hit.

    Send that, and see what they come back to you with, if anything !!!
