Facing disciplinary for gross misconduct

Hi,

I have been subjected to a disciplinary process, including a full investigation and I am to attend a disciplinary hearing later this week.

However, the investigation was blatantly biased and incompetent (according to my reading of the ACAS website).

2 things - do I complain about the investigation/investigator now and, if so, does this constitute a grievance against the investigator?

I really don't know what to do - wait until the hearing itself or tell them now about these issues? The investigation has already been re-opened once as I complained that certain points hadn't been followed up after my initial investigatory meeting.

Grateful for any advice, to be honest, as I'm totally distraught about what to do.

    What does that say about your relationship with them and what they think of you let alone the chances of keeping your job.
    Gross misconduct usually means automatic dismissal .

    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    Are you a union member? If youre not a member, or if you have been a member for less than 1 month, (from what I can remember) they wont be able to provide legal support. But you still might be able to call your Union representative and get some advice. That's what I would suggest.

    My union representatives have always been really helpful and I am very grateful to them for their help and support

  • 6 years. I was under a lot of pressure and stress due to the implementation of new sales systems which were not fit for purpose and made 2 errors dealing with 2 sales processes. The company had a 20% adviser turnover after the system was introduced (previous year was 8%) but I stayed on and became so stressed out by it that I was making errors all over the place for 12 months before the investigation. Yes, I did not follow the sales process (financial services). I did not shoot anyone or kick anyone in the balls.

    No, I'm not a union member, unfortunately.

    If you are if financial services and you did not follow the sales process you are probably indeed in a lot of trouble.

    I would suggest you don't raise the grievance now but allow this process to play out and then raise the issues as part of your appeal. Sometimes you have to accept that things are not going to go your way and rely on the appeal process to put you in a position to be reinstated or to have a settlement agreement offer.

    I would go for the pragmatic approach and start looking for another job out of the financial services sector asap.
