Job offer cancelled !!

Hi

A month ago I went for a new job and got it....signed contract extension etc and all seemed fine. I have to give 3 months notice to my current employer and was due to start in the middle of January

This week I got a phone call and letter telling me that the offer of the job no longer stands due to budget cuts and poor results in the business.

I've given my notice in and my current employer have found someone new and they have been really good in the situation

Do I have any rights?

    This is why you should have been looking for a backup as things change eg budgets get cut. I don't believe there is anything you can do.

    Unfortunately, no. You're powerless. Companies often do this, it's happened to me in the past, but (luckily) I wasn't in a job at the time.

    What's worse is that, having left the job you're in, if you've not found a replacement, the Dole Office will deem you as having "given up your last job", so you might struggle to get paid your Dole too.

    Of course, you can always ask your bosses to keep you on. They might say yes, they might say no. But, you've queer'd the pitch with them, so even if you're retained there'll be an uncomfortable cloud hanging around.

    A backup? how, like find a 2nd job, get the offer and jump on that if the first job doesnt work out? Good work if someone has managed that before.

    You had a phone call and LETTER. for tht reason there is 0 chance of you getting sanctioned at JCP, so dont even worry about that.


    Sorry to hear this has happened, if you are close to your boss then maybe they will keep you on but you need to tell them sooner rather than later and hope for the best.

    Granted the person they found may end up in your situation, every action has a reaction.

    I thought they had to pay you for the first month if this happened? surely you can't just cancel contracts on a whim with no compensation?
  • I know of this happening, I'm sure the to be employee received a pay off - and that was only for a 16.5k paying role, whether just generous I don't know.

    We later followed said person to the dole queue anyway this was a couple of years ago now. Again all paid off as if redundant and even as far as advised of a couple of recruitment agencies to go with that knew the company and it was said they would look after us.

    I sincerely can't imagine you not being eiligable for JSA if post in leaving company has been filled. Least the not so bad cowards didn't make you start and then find a spurious reason to be letting you go 5 days later, cold comfort I know. Get yourself back out there and pick something better up. :)

    The other individual hasn't started yet, your priority is to protect your own
    interests.
    If the offer is later withdrawn the employee may be able to claim damages for breach of contract (Sarker v South Tees Acute Hospitals [1997] IRLR 328). In most cases, damages are limited to the length of notice needed to terminate the contract legally. However, if the contract is for a fixed period of time and there is nothing allowing for it to be ended earlier, damages could potentially cover its whole period (Gill and others v Cape Contracts [1985] IRLR 499).

    This seems very unfair on the original poster who did everything right ie accepted the role and worked the notice. Maybe post the name of the new employer to name and shame them?

    I would hope the welfare system would support the op in these circumstances.
  • I'm in a similar position. Started new job then let go after a few weeks for no apparent reason. Can't go back to my old job. Now facing the prospect of signing on and trying to find a new job. Just before Christmas as well. :( I'm hopeful things will work out for both of us. You're not alone.

    I have to be honest, were I the manager in that situation I wouldn't let anyone come back, no matter how good they were, especially if their replacement was excellent as stated by the OP. I'd just assume they'd leave as soon as they found another job and I'd imagine most managers would feel the same.

    You can try but I'd focus my efforts on finding another job.

    Correct. You've entered your contract and therefore they'll need to pay you your notice period. Still not great for you but at least it gives you another month to find a job. I'd pursue this quite heavily (ie: would take it to court) in your situation, you've no relationship with them and therefore nothing to lose.

    I feel for you, it's a bad situation to be in but keep on the lookout for another job.
