Long term overpayment advice

Hi,

After getting a statement from my employer of my annual earnings it appears I'm receiving £50 a month extra payment that I don't think I'm entitled to. Looking back over payslips this could go back 10 years.

I want to go back to my employer and tell them and have no issue in starting to repay it if indeed I shouldn't have been receiving this money.

My question is more around other actions an employer could take. I guess I need to see my employment contract, but could this be constituted as misconduct?

    I think if firm has been paying it for so long, it could be argued that they have accepted the money is due to you, so not recoverable - pay rates etc surely would have been checked by SOMEONE, during that time?

    have you been on the same salary for 10 years? sure it's not a bonus, or tax code error?
  • Hi, I've had a pay rise and bonus every year. This unfortunately is not related. I don't have an issue repaying it. I'm more concerned with his it will be looked at by my employer and any misconduct.
  • Im not sure how any reasonable employer would view it as misconduct if you are the one to bring it to their attention and are agreeable to paying it back.


    Its not as if it is a massive overpayment per month that would be immediately noticeable to the employee and therefore would be expected to report.
