Invoice for item I never ordered

Hi, unsure if this is correct place! I recently received a package with a teeth whitening kit and an invoice for £87 which apparently came from a company called GoWhite from Australia :huh: which I hadn't ordered at all!

So I googled them and found out they seem to be a real company and they had an online messaging system, so I told them I never ordered this etc.... at the end of October.

I then received a reminder from them regarding their invoice after not getting a reply from my online message I left them, at the start of November so I dug deeper and found a european email address and I again told them I didn't order this, send a prepaid envelope and I'll be more than happy to return this.

Today, while at work, my Fiancee has told me they have delivered ANOTHER package with the same teeth whitening kit and another invoice for £87!!

My plan is to find a phone number and call them on Friday after work (I finish earlier) but where do I stand with this? I have never asked for any of this but it is addressed in my name and my address??!

  • Have you thoroughly read over your online bank statements? That would have been my first port of call. Make sure someone hasn't actually stolen your details and is ordering things from themselves and charging them to you.

    EDIT: worth checking paypal etc, too.

    Thanks for the reply. No nothing dodgy on my bank (recently got a new card because I snapped my last one anyway!) and Paypal is fine too. No money has actually been taken by them, just an invoice asking for money.

    email them back with an invoice for storing their property until they arrange for it to be collected or sent back to them. £20 per day.

    You are allowed to keep unsolicited goods, you do not have to pay for them, although how many teeth whitening kits do you need lol.

Unsolicited goods are also covered in the newer regulations The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 which say you have a right to keep goods delivered to you that you didn't request."

    I had a similar issue with phillips once, sent me two mobile phones, completely unsolicited, emailed them, as you have, no response, kept them 6 months, then sold them on eBay, never heard another peep from them !!!

    Inertia selling

    39. Before regulation 28 of the Consumer Protection from Unfair Trading Regulations 2008(1). (and in Part 5 of those Regulations) insert—
    “Inertia selling

    27A.—(1) This regulation applies where a trader engages in the unfair commercial practice described in paragraph 29 of Schedule 1 (inertia selling).

    (2) The consumer is exempted from any obligation to provide consideration for the products supplied by the trader.

    (3) The absence of a response from the consumer following the supply does not constitute consent to the provision of consideration for, or the return or safekeeping of, the products.

    (4) In the case of an unsolicited supply of goods, the consumer may, as between the consumer and the trader, use, deal with or dispose of the goods as if they were an unconditional gift to the consumer.”.

  • Did you or your partner agree to pay postage and packing to trial a product-prob teeth whitening in your case. Typically you would agree to a small amount of about 3.95. If you don't cancel the trial within 14 days then charge you for having the product (the £87) and then charged monthly £87 odd and get a monthly kit until you cancel.
