DMC dilemma

Need advice, again! backwherewestarted, the advice I posted still stands!!!!! I have requested all CCAs from my creditors, 1 has already informed me they can't get the required info, therefore unenforceable, all the others have said they have requested them, however, as we know these debts are unenforceable whilst they wait for them to be located. All are 10 years old, have been passed several times to other companies so the pre 2007 law means a recon may not be sufficient (thanks everyone, wouldn't have known half if it wasn't for you guys!!!!). My problem is, my DMC, who have been priceless I have to say, are not getting the info I am passing to them. They are insisting I need an IVA, (sourcrates has already advised me why would I get an IVA on unenforceable debts & correctly so!).
I have also taken on board the fact that if they should locate the documents I will resume payments, but still my DMC are telling me 'their way or not at all'. I was hoping to stay with them a little while longer, but they are 'nicely' trying, I feel, to push me to agree to this IVA. My concern is how I can take over from them & contact the creditors I do need to pay, due to court action? I am hoping to achieve F&F eventually, any advice will be so gratefully received! Don't want to 'cut my nose off' so to speak! Sorry for long post!

Hi sourcrates, no, they are a charity. They think this is the way forward as our income has dropped & it will take 20+ years to pay off. They have been brilliant to be fair, but because I've been with them so long they are probably trying for a quick resolve, as they are a charity, they have loads on their books, we've certainly been 1of the longest they've had!!0

Hi Tracey
If you want to negotiate with your creditors yourself until you’re in a position to try a F&F you could use the sample letters on our website and send them a SOA:

You might also find our F&F factsheet useful:
