N245 Form

Hiya all,

Just helped someone to fill one out

Quick question though, does it go to his local court or to the court it was lodged against him?

Also there is a fee ( think its £50 ) how is this paid as not mentioned on the form itself

Many thanks as always :-)

If you're returning your claim form online, you can only pay by direct debit or credit card but the fees will be cheaper. If you're paying by cheque, make it payable to HM Courts and Tribunal Service. To download a leaflet containing the latest fees, go to https://www.justice.gov.uk.

    Hi

As you’re sending an N245 (presumably to vary the instalments on a CCJ or suspend a bailiff warrant), it’s different to responding to a money claim online.

As far as I’m aware you’ll need to post it and send a cheque or postal order. These FAQs don’t reference any online payments for the N245:

    www.justice.gov.uk/courts/northampton-business-centre/ccbc/frequently-asked-questions

If I want to reduce the instalment amount, what can I do?

You can complete an N245 form, to apply to reduce the instalment amount and send this to the court. Your application will then be considered. You must pay an appropriate fee - Please refer to the Civil Proceedings Fees (Amendment) Order. The cheque or postal orders should be made payable to HM Courts & Tribunals Service. If you are on benefit or cannot afford to pay the fee you may complete the EX160 form, Fee Remission form.'

You could always contact the court directly to check with them though.

  • Hiya a quick follow up on this,

Spoke to him yesterday and he sent it signed for and was received by courts on the 8th December, he has yet to have a reply- he has tried calling but can never get through and has had no reply to the email address given on recorded message

Is it normal to take over a month to set up? I appreciate its been Xmas holidays etc but have no idea on timescales for these things

    Hi

Timescales can vary from court to court depending on how busy they are but taking over a month does sound like a long time. Christmas may be to blame as you say, but you ideally need to ask the court directly. You could check whether there are any alternative contact details using the court finder on this website:
