Hi,
I work as a financial adviser for a insurance company, I have recently resigned, the day before my disciplinary hearing for poor performance over the previous 6 weeks against a plan, and failure to follow the sales process, nothing major, just using paper application instead of the system. They called off the hearing when I resigned and put me on gardening leave, my new employer has asked for a reference and they have received one and are querying one aspect not related to above, again nothing major.
I received an email today asking me to attend the new hearing on Friday, my last day, I got this email today.
I'm considering not attending the meeting, I am currently suffering with back pain.
Can they still hold the meeting if I'm off sick and if they do what is the potential outcome if I have left the company.

Does the back pain stop you sitting in a meeting for a short time?
If you fail to attend they can hold the hearing in your absence. They can revise their reference if they chose to do so.0 -
Surely you want to be cooperating with them, they could always send an amended reference stating X refused to turn up to a disciplinary hearing.Hi,

A reference that reads "Dunneyboy was subject to disciplinary processes due to poor performance and failure to abide by the sales processes. He resigned, and was unable to attend his hearing due to a bad back"
If the first sentence doesn't damn you, the last one will - the "bad back" is quite probably more damning than the performance because every employer thinks they know what a bad back means, and believe me, it will not be favourable. A bad back, along with stress are legendary as excuses, and as a result many employers simply don't believe either, with or without a doctors note. It comes of so many people faking it. Funnily enough this diagnosis often coincides with a disciplinary process.0
