Do we just respond and advise that we wrote to CC company on x dates and requested CCA under S78 and until they comply the debt is unenforceable? Is there a standard letter/wording anywhere?
Thanks for you help
Usually it is best to repeat the whole CCA request to the new creditor, but make it clear that the original request also still stands and the debt hasn't magically become enforceable again due to the debt being sold.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Typical responce in a lot of cases, usually the creditor simply can't be bothered, and to avoid there obligations, simply disguise non compliance by selling the account !!!I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Response received from PRAt group today. Returned my £1 postal order.
They will request information from original creditor. Will suspend collection activity pending response from original creditor.
Big list of what they have to supply us, and what they don't have to supply us.
Lot's of information about if the debt is unenforceable it's still owed and not paying will affect credit reference files, likely to register default etc. etc.
Says they can still sell the debt on even if they cannot produce paperwork plus lots more information I already am aware of...but they have to do their job and inform us.
No response to second letter sent to MBNA....but they sold it so they won't care

Again, to be expected. Seems likely you will have await a copy of what MBNA sent, and then reply the same way again if it does not comply with what is required under s78.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
