I doubt that a solicitor will help, most havent a clue about private parking civil issues and any that do cost an arm and a leg and will cost more than your parking invoice
there is nothing you can do to stop it being passed to debt collectors who have 6 years to harass you
LPS or the landowner themselves could take you to small claims court sometime in the next 6 years , where you have the right to defend yourself and prove your right to park (if you have the legal right to park)
if a judge was to determine that you should pay, a judgment would be forthcoming and you have 28 days to pay it, or a CCJ will ensue and possible bailiffs will be knocking
a debt collector cannot take you to court, only LPS or the landowner
its an IPC registered company , so none of them are on "your side"0 -
I see this is an IPC mob, so the only appeals service available to you is the IAS kangaroo court.
What does the property lease say about parking and permits? The terms of the lease should trump any made-up rules from a scummy PPC.
Did you own up to being the driver when you appealed?Bournemouth - home of the Mighty Cherries0 -
its LPS , an IPC member
I would suspect its in England0 -

I am sure there is a legal aid or a win no fee solicitor can help me to stop me to take to court to pay for a unfair fine.
If LPS pass it on to debt collectors, what I can do to get away with it without pay them the money that I don't owe?
If LPS take me to court, how I can defend myself when I have the legal rights to park my car in a private car park that I got the wrong permit?
I was told by the notice board that I would have to move my car from a private car park used the visitors permit which start from 9am to 5:30pm then move my car to another private car park in the same area which start from 5:30pm to 9:00am. I don't want to keep moving my car in everyday as it is harass me and I can't see any difference from moving my car to another private parking when I live in the same area. I have told LPS that the housing associations gave me the wrong permit, but LPS has rejected my appeal.
I don't know what I am going to do, can you advice me what I need to do?
What would happens if I don't want to talk to debt collectors and how I can stop them from bothered me?
Do you mean LPS (London Parking Solutions) can take me to court?
How I can get away with it to stop pay the fine?0 -

It says that I will need a permit to park my car with a visitor permit (from 9am to 5:30pm then move it) or a permit to park for 24 hours. I got the visitor one which the housing associations gave me the wrong one when they did not put me on the tenancy. What the property lease say for visitors permit I must park my car with visitor permit from 9am to 5:30pm then move my car to the hall in the same road which I am allow to park there with a visitor permit from 5:30pm to 9:00am. I can't see any big difference to keep moving my car in the same area where it stays for 24 hours 7 days a week.
I can't keep moving my car from a private car park at the hall in the morning to move it to a private car park (at the back of my garden) to leave it there until in the evening then move it back to the hall to leave it there in the evening until in the morning. I don't want to keep moving my car in every morning and in every evening as I'd find it impossible to keep moving my car in everyday when I need some rest and when I am sleep in bed.
They are being stupid to make me to keep moving my car when I have the legal rights to park my car at the back garden for 24 hours 7 days a week because I live in the same area. There are two private car parks in my area, the one is near the hall and the other one is at the back of my back garden.
Yes, I am the driver that I have appealed but it has been rejected due to no permit on my windscreen. I have explained to the parking firm why there was no permit on the windscreen as I got the wrong permit (the visitor permit), I am waiting to put on the tenancy which it will get the permit to park my car at the back garden for 24 hours 7 days a week. I feel they are being harass and discrimination me.0 -
its not a fine , its an invoice, in civil court and I doubt you will get any free legal services for this, not legal aid , nothing , nada
if you feel so strongly about your case, then argue it in front of a judge (if they issue a court claim in the next 6 years) , producing paperwork to support your claim (think of it as being like Judge Rinder on the tv)
there is nothing you can do to stop the debt collector part, you are not in control of this, the PPC are, and the PPC , (yes LPS) could try a court case, as could the landowner, you have already been told this earlier
you seem to be looking for an easy getout from this, there isnt one, not unless you can persuade the landowner or managing agent to cancel the charge (the invoice)
this is a civil case, so its not a fine , its an invoice0 -
As this is a Housing Association I would expect that they have Counsellors/Advisers to deal with matters such as this. Have you written to the HA?You never know how far you can go until you go too far.0

Thank you for your advice, should I go to citizens advice to get a legal advice? What about if I could see a solicitor?
Yes I would argue to a judge in front of me if they issue a court case in the next 6 years. I would prove to him that the housing association was in the wrong as they gave me the wrong permit as a visitor which it should be a proper permit one to allow me to park for 24 hours. And I would also argue to the judge that the housing association was in the wrong as they should have not employed the parking firm when it put me in alot of stress that picked on me which is unfair when I have every right to park my car in a private car park without being moving in every morning and in every evening which is not necessary. It is same private parking and I can see no difference of being moving in the same private parking area.
I would need a solicitor to back me up to support my case if LPS or PPC take me to court. And I would need a solicitor to stop LPS to pass it on to debt collectors which they will cause me harassment. I don't want any stress from them and I don't want anything to do with them. All I want them to stop bothered me and leave me alone.
What do you mean by PPC? What it make me worry is if they take me to court and make me to pay, the judge would give me 21 days to make me to pay or else he would order a bailiff to take my personal things away which is not legal and I don't find it is fair when I got the good reasons to park my car in a private car park as I live there for 20 years as it never used to!
I feel it cause me an harassment whoever did employ LPS that make me pay the fine because I live here, I want to sue them for cause me an harassment.0 -

No I have not write to housing association. I am waiting for counsellors to put me on the tenancy to allow me to have a permit to park my car in a private car park for 24 hours, but it wont do anything with them as it will be between me and the parking firm. It is their fault for giving me the wrong permit as a visitor when I am a resident but my name is not on the tenancy and it is their fault for got me the fine when they employed the private parking firm.0 -
