Strange situation

Hello,

I'm just looking for bit of advice on my current situation. I am 27 and in September 2013 i started a temp job through an agency, it was originally only meant to be a 8 week assignment but it kept getting extended the last extension was till March 2016.

Unfortunately i have suffered with mental health issues as far back as i can remember. I was signed of from work in September 2015 for depression and anxiety which i am currently getting receiving treatment for but i have no idea how long it will be till i can return to work. I am getting Statutory Sick Pay through my temp agency.

I got a phone call last Monday saying that the company i was temping at had ending the contract which wasn't great news. The temp agency have said they will continue to pay me Statutory Sick Pay. This is confusing me as i don't have a job how/why am i getting SSP?

  • Because the Government covers the cost of SSP and not the agency itself. So its, presumably, no skin off their nose to continue claiming it for you.

    As put this stopped a while ago, The OP's employer is the agency so if they stopped paying SSP they could possibly have a claim made against them.

    The agency's contract with the customer is down to them.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    Your agency is your employer. Your contract with them is separate from their contract with the company to whom you were sent.
    It sounds as though the agency were letting you know that the assingment is over, so when you are ready to return to work they will need to look for a new placement for you.

    The agency may be able to end your contract with them but would have to go through the proper process which may include arranging to met with yiou to look at whether you are likely to be able to carry out your job and whether there are reasonable adjustments they could/should make to facilitate this.
