My husband has CCA'd Capital One and sent the one pound postal order.
They have responded saying 'the signature that you have provided with your letter doesn't match what we have on our records' and they want a copy of a document like a driving licence etc.
Is it obligatory to provide a signature? He deliberately signed with an alternative signature to avoid any unscrupulous behaviour on their behalf. Can we say that to them?

You can write back and tell them that there is no requirement, in the consumer credit act, for you to provide a signiture, for a section 78 request.
You can also state that if they require a copy of your signiture for data protection purposes, they have been happy to send statements to you, and other confidential information, without the requirement for any signiture, previously, so why are they asking now ?I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. While there is no requirement for you to sign it, when making a request to an original creditor rather than a DCA, most of the time it's not worth the bother of having that argument, as I can't recall ever hearing of an OC lifting a signature.
