i have been TUPE d and they cant get the tax right

The lease the business that I and colleagues work in have been sold and we have been transferred to a new company under TUPE. I understand that terms of employment etc have not altered however after nearly six weeks most are still on emergency tax as the new people claim that they never received more details than names addresses and bank details. The previous employer says they included tax details, new employers say not.
It doesn't help that neither have given us payslips for some time.
The new people said the old should have given us P45 and P46 - old employer says he was advised not so.
After 6 weeks its beginning to seem that it will never be sorted- how can the new employer sort this without the goodwill of previous one?
What can we the employees do to help the situation get sorted?

    Tupe is transferal of continual employment with all personal contracts in place from previous employer, basically some job, same conditions, different company.

    All that getting a P45 will do is reset your personal circumstances. New contract provisions will then be employed as you will have technically resigned from the company then rejoined.

    Thus you will reset things like redundancy packages, eg if say you have been working there for 6 years you will get 1 week or 1 1/2 weeks depending on age. If you get P45 you will get nothing if they reemploy you as they say you have only just been employed.

    Also I thought it was illegal not to be given a pay slip telling you what deductions you have paid.
