Vehicle finance - early termination
Hello everyone sorry if I'm not posting this on the correct section, I'm new to this, I'm after some advice
In May of this year I got a brand new Vauxhall vivaro van through a well known finance company on a lease, cut a long story short not long after I got it, it developed a fault on the gear box, been in and out the garage spent over a month in the garage in total. Have rejected the van to the finance company which they accept as its not fit for purpose. Question is am I entitled to a refund on my deposit and repayments as the only reason I'm rejecting the van as its faulty and costing me time and money in all the visits to the garage. Any advice would be greatly appreciated.
Many thanks

Hi Lukey,
Under the sales of goods act (1979), if they have sold you a new car that is not fit for purpose, then the supplier is in breach of this act and a full refund is due.
I would pursue them fervently for this, alluding to this act and legal action if they do not respond promptly.0 -
Thank you, I was under that impression as well.
Have spoken to a friend that was in the same situation a few years ago, and he got a full refund.
Just wanted a bit more advise before I gave them chapter and verse.0 -
Just check. As it was a van you bought, not a car, was it bought for business purposes? If so, the rules may be different to those which apply to personal purchases."There are not enough superlatives in the English language to describe a 'Princess Coronation' locomotive in full cry. We shall never see their like again". O S Nock0
