Buying back the house from OR

Hello. My husband was made bankrupt two years ago and I want to buy the house off the OR. The house has quite a bit of equity and is not in my name. The mortgage payments have all been coming out of my account. Is there any way to bring the cost down for me to be able to buy BI? The house has 40k equity will I have to pay all of that and if so is there any form of payment plan. We have two young children and don't want to be homeless. Thank you in advance for any advice

Hi,
You could try and claim that some of the beneficial interest belongs to you by mortgage payments made, but is it actually the case that the funds came from your income (ie not from husbands income put through your account, or income in to your account from a joint account)
The assumption starting point is that 100% owner equals 100% beneficial interest.
Have you not heard anything since the bankruptcy 2 years ago? Has the case not been passed to an IP?
The OR / Trustee has 3 years to deal with the property, and it would be highly unusual but not impossible that your case has been forgotten about / miss- filed.
If so, the worst thing you could do is make contact!
