    For health & safety law purposes, a 'self employed' person is defined as someone who does not work under a contract of employment and only works for him/herself.

    If you are self employed but employ others, then in effect you are still an employer and UK health and safety legislation will still apply.

    I think you are specifying the construction industry which incidentally is deemed as high risk and the new legislation (The Health and Safety at Work etc Act 1974 (General Duties of Self-Employed Persons) (Prescribed Undertakings) Regulations 2015 would not apply to the self employed in construction in respect of exemption to UK safety regulations.

    The site operators would also be required to adhere to general Health and Safety legislation and more specifically the CDM regulations and will almost certainly enforce a mandatory PPE zone irrespective of employment status.
