Hiya.
I'm a self employed mechanic and to cut a long story short, a regular customer had said they had paid some money which they hadn' and stupidly iIhad written out a couple of cheques for just over a grand to Euro Car Parts.
Well, they bounced and along this time I had two members of family die and got married.
Anyway I emailed Transax who paid the chequesas they do and asked how much I owe. He emailedback and said just over a thousand. Now they had sent letters with £75 charges and £90 charges etc but they were not actually asking for any additional costs.
Anyway I'm thinking ok let'spay this as soon as a couple of jobs are paid i.e this week. Today i get a weird and rude phone call from MIL. Now Transax ask everytime for name address date of birth for securit. This guy just said "is that Josh" and then proceeded to say I owe 1800ish by tomorrow or legal actual starts. He also then said just to let you know I have recorded this phone call to prove I have said legal action starts tomorrow. I say I'm pretty sure you should have said that at the beginning of the call but he says no.
Anyway he rings back as requested and I listen to his drivel. He says he can offer me 40% off if I pay in full tomorrow. I ask where this remaining 40% gets paid and does Euros lose the money and he basically says yes.
I accept none of this and acknowledge then I say I have never heard of MIL, asked for things in email which he says no can't do for data protection. He says debt came from Squeezy Ltdvor something. I say I have only heard of euros and Transax, to which he says squeezy Ltd is Transax or something.
Anyway. I do owe the money. I don't want to pay the fees.
I tell the guy look mate, I have no idea who you are. I say you have no idea who I am, you have asked no security questions etc and just given details out to anyone on the end of the phone. I didn't even confirm I was me. He says he doesn't need to as it's a LTD company.
Anyway he has now emailed the details????
The supposed 40% off is just the original bounced cheques. No fees on top! Lying !!!!!!!s saying euros would lose.
Anyway. Should I skint and pay in full. Apparently I have until 17.30 tomorrow before legal action starts for the whole debt which is nearly double the 1060 they want in full.
Should I just ring Transax and ask to pay them direct and not give these MIL clowns the money?
Do I tell them to jog on as I have had nothing at all in writing?
I'd rather speak via letter but the time limit is worrying me but at the same time I'm wondering if that's what they want.
I'd rather pay in installments tbh but if I have to just pay it I will.
Cheers!

Sounds like threats and harassment to me.
You need something in writing (old fashioned letter)
If they want to start court action, they must first send a 'letter before court claim'
I have heard of MIL collections (pond life) - do a quick google on them0 -

Hi [TEXT REMOVED BY FORUM TEAM],
Will look into this. Fair enough if true.
[TEXT REMOVED BY FORUM TEAM], I need some more information on this "debt". MIL Collections have popped up out of nowhere and asked for over £1800.
Euro Car Parts state they are not owed anything.
Could I have some more details please?
I also request email communications.
Yours sincerely!
Josh

All are correct. The most annoying thing is, while I was in hospital with family members Transax reissued the cheques about 30 times and racked up ridiculous bank charges!0 -
Quick couple of questions as they have offered two split payments.
There's still about a £50 charge on top of the cheques.
One what kind of evidence can iIrequest and can i make them hold to settlement offer for a reasonable period of time?
Transax one minute want £1061 the next minute a company called MIL ring and want £1800.
If I dont settle now am I going to be liable for the extra £700 in fees?

Hi Josho
I'm not particularly convinced by the threat to begin legal action if the debt's not settled by 5.30pm today. Quite apart from the question of who would launch such a process on a Friday evening (!), they do not appear to have satisfied pre-court protocol by sending you a "letter before action", as per fatbelly's post further above.
I also very much doubt that any offer of a discount will disappear forever after today. The MIL rep is paid for getting results, and if offering you a lower settlement figure makes that more likely then they will keep the offer - or one like it - on the table. Whatever you end up agreeing to, you really need to confirm in writing with them, otherwise there is the risk that they later shift the goalposts and chase you for more on top. We have a sample letter for negotiating a lump sum offer in "full and final settlement" which you can find at:
https://www.nationaldebtline.org/EW/factsheets/Pages/24%20EW%20Full%20and%20final%20settlement%20offers/Default.aspx
If you need further information from Transax, you should be able to make a "subject data access request" under the Data Protection Act - see this letter template:
https://www.nationaldebtline.org/EW/sampleletters/Pages/Personal-information-under-the-Data-Protection-Act-%28sole-name%29-.aspx
Whether you see this as useful depends on how much more info you think they hold beyond what they have already given you. If the debt is valid and you've decided to agree to a settlement of £x, it arguably doesn't serve much purpose.
