I need help with cabot to.
In a nutshell cabot contacted me with an old debt it went straight to northampton court.i followed online advice to defend the debt from 2003.online advice told me not to enter a defence .I didn't. The court then ccj ,d me for not entering a defence. I wrote to cabot for a cca request. They couldn't provide the paper work .They wrote to me two months later saying they couldn't enforce the debt in court etc and no action could be taken because of the cca request and lack of original agreement.i wrote back telling them the time line for the request had expired for the cca and to stop chasing me fir the debt etc .They now have written to me saying the debt is enforceable because the ccj came first .The ccj was issued in December last year. They are saying they do not need the cca because the court gas made the order. Please help .

Hi,
You would need to go back to the court where the CCJ was issued, and apply for a set aside judgement, you need a good reason, and it will cost you a fee of £155.00.
Its a bit of a lottery weather you will win or not, you may be wasting your money, but its your only option if you want to avoid paying.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
