Does my employer has the right to not pay me in this case?

    You should be paid for the time you did actually work.


    So - though they may not have to pay you for the notice period you did not work (you would need to show that they told you not to come in, which, from what you have written here, doesn't seem to have happened) - you should receive pay for the time you did work.

    I think Littlevoice is correct, you are only due to be paid for the time you worked, as it sounds like they gave you a choice and you chose not to go in. Had they told you not to go in then it would be different.

    You could also call ACAS and they'll be able to tell you for sure. Not sure if anyone asked if you worked there for more than 2 years? You rights differ slightly in other terms at the 2 years employed point.
