Council Tax

I've just read that unpaid CT can be written off in BR (If i read it right:rolleyes: )
I have an ATE for last years CT, does anyone know if this is included- i never went to court though.
Got OR interview next week so i suppose they'll let me know but would be nice to find out beforehand.

    Assume 'ATE' is attachement of earnings?? If so, then the Council will have had to go to court to get a 'liability order' (you can check this with court/council but I'm 95% sure they HAVE to get this to allow further action). If a liability order has been granted then THE COUNCIL TAX WILL BE WRITTEN OFF/INCLUDED IN THE BR for that year. For this year-again if a liability order has been given the WHOLE YEAR is written off-if not contact the Council, give them your BR date & they will send you a new bill from the day after BR.

    If there was a liability order for last year (as I said I'm 99% sure there will have been) make sure it's listed as a debt for the OR & i WOULD ALSO (FOR YOUR OWN PEACE OF MIND as the OR can be a bit slow!) write to the Council to tell them that the last years C Tax is included in the BR & they must now deal directly with the OR. Hopr this helps!

    I wonder though if they will refund me what i've paid since BR..somehow i doubt this can be done and its only one months payment.

    I had a client in exactly the same position... it took the CTU 5 weeks of £90 pw payments before they stopped the AEO... Contact the CTU and inform them of the BR date and ask them to stop the AEO with immediate effect...

    My cleint had to write 2 letters of complaint to the CTU before they stopped the attachment and then when the refunded the money they sent it to the OR (as an asset) who will now not give it my client dispite several letters to them.

  • Thanks Plumduff, thats really helpful. I have emailed them, but think a letter and a copy of the Br maybe a better idea. I'll even do a back up of complaint letters-just in case! I speak to my OR next week so will mention this to him and see what he says about the refund (too be honest its small, only £20 pm so hopefully i can have at least this months payment back but won't hold out too much hope)

  • Hope you get a better result.. to be fore warned and all that crap... Send the BR Order by fax (several times if necessary) and phone to ensure its been recieved and acted on.. asap..!
