Dismissed - Gross Misconduct due to lack of contact HELP

So i was recently dismissed due to lack of contact and unauthorised absence which my employer classed as Gross Misconduct whilst i appreciate why as i was off work for 2 months due to my serious aniexty issues and long history of depression/psoriasis and stress, I had been working at this company for 2 years and before i was dismissed i wasnt on any formal warning or such.

I didn't appear at the hearing and didn't appeal because at the time i was struggling really bad mentally and that's the whole reason why my contact stopped, is there anyway of doing anything about this now my head is slowly clearing?

To compound the situation i have huge debts and from reading probably can't even claim jsa, i am applying to alot of jobs but only had one interview which probably failed because i was honest and told them why I lost my job.

Any help, advise? Because Everything together is making me even worse and i dont know where to turn i have less than no money, no family to help, I'm stuck. And undoubtedly it's my fault i know but i need to find w way out of this

    Firstly, you need to see your GP. If you had done that, it would have been easier for you and your employer. For other issues such as not attending hearing etc, don't think you will be able to do much now.

    Define recently - are you out of time to lodge an appeal, if so ask if they will consider one taking into account your state of health (long shot but little to lose in asking).

    Can you elaborate on the lack of contact, how long were you AWOL for?

    Did you contact them to explain why you could not attend the hearing? Did you submit any medical evidence regarding your condition?

    They were fully aware of my long term illnesses and issues i was submitting sicknotes upon till i got that bad that i didnt leave the house at all for a clear month. I was awol for a month signed off sick for 6 weeks previous to that.

    28 days since the hearing and decision to dismiss me. The consideration due to state of health might be a shot. Thank you.

    I know the lack of contact even to my gp was a mistake, but wasn't thinking straight at all.
  • Ask them to reconsider the time limits for appeal but you really have dug yourself a hole here.

    Need to be apologetic and make sure if they remove the GM that you make the effort to contact them at every point, not wait for them.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    I'm sorry to hear about how you've been feeling.

    I do think the Company has acted reasonably. The big issue for them will be that you were under medical supervision and then withdrew from that too.

    Do you feel ready and able to go back to work if the GM was removed? If you don't then it's probably not best to appeal to them. You could ask the DWP whether you might be eligible for ESA. You really need to tell your GP everything. Chapter and Verse.

    If you do feel ready to go back to work then you could appeal to your employers better nature.

    The issue is not so much returning to that employment but to overturn/ rescind the sanction resulting from the hearing. Other jobs are being applied for, the op has a job of work to do in terms of reference from this employer, an appeal hearing may open the door for a skilful case statement to attempt to soften this blow.

    On the topic of your debts, post details on the Debt Free Wanabee forum. There should also be a booklet published on MSE specifically for those in debt with mental health issues. The forum members, and the debt management charities mentioned in the booklet, will help you come up with a debt repayment or write-off strategy.

    Also, pop over to the benefits forum. They will be able to advise you of sanctions when it comes to JSA but also of any sickness or disability benefits you may be entitled to, like ESA and PIP.

    Are you getting any medical or welfare support for you issues from your GP, a counsellor, online mental health advice websites like MIND and so on?

    If you are feeling low, do consider contacting the Samaritans. They will provide a non-judgemental and sympathetic ear to anyone undergoing a crisis.
