What next?

I've been declared bankrupt and now await my interview with the OR. I was told not to send bank statements with the info pack i'll be receiving shortly.

Any idea why the OR doesn't want my bank statements right away?

What sort of information do they ask for in this pack?

Does anyone have any advice on if I should make contact with any creditors to let them know?

Early days but if I make contact should I ask that they ensure no defaults are recorded after my order was made?

Does the OR contact every single creditor?

Thanks

It's all out of your hands now - no need to contact anyone and if they (creditors) ring you - just refer then to the OR.

You will normally be expected to send copies/details of accounts, loan agreements, tenancy agreement if you are renting (and in your name) or mortgage statements, evidence of income etc. I was asked for bank/CC/store card statements, utility bills etc. Basically evidence of everything you included on your BR petition.

CRA defaults etc are useless until a month or two after discharge, don't worry about it yet.

The OR will contact all creditors but be aware it can take several weeks.

Thanks, I don't have any agreements for loans, car etc and statements are non existent. Likely to be an issue? I could always ask the creditors for the info I guess.

Give the OR what you can - they can get bank statements direct from the bank. You should try and be as helpful and cooperative as possible. Try and provide some information for each of the debts listed on your petition, even if its just some notes about when and where the debt was from.
The OR will say in the pack what they are looking for.
  • Hi Alltaken im in the same boat im waiting for my call from the OR on thursday they want details of all debts statements bank statements lease or rent agreements 3 months wage slips recent debt correspondance loan agreements and cheque books. My OR said not to send any info back until after the call so im not sure if he is going to give me a figure on the interview of any IPA I need to pay back or later . Im not looking forward to the interview to be honest my OR sounded very strict and ultra buisness like on the initial call after BR

    Anyway good luck.

I can say only one thing, don't worry. My OR sounds very similar and my income is comprised solely of state benefits, so no IPO/IPA is possible, however, my OR did tell me not to send any bank statements until after the interview on the phone.

Sounds to me like a pretty normal occurrence if you have been told the same.

The way I'm looking at it:

It's a maximum 2.5 hour telephone interview just going through what was owed to who and why.

The worse that can happen as a result is a BRU/BRO for potential misuse of credit/fraud. So be it. If that happens it happens. Main part is done, debt is gone and I can move on. I'll post an update after my interview on Thursday. Hope to hear from you again, take it easy!!

    Guys,

You almost certainly won't get to talk to the OR in person, unless you are very important, very naughty or owe a shedload of money.

Your telephone interview (and all the initial information collection) is done by an Admin-type grade person working in the Insolvency Service - usually called an "Examiner".

So, nothing really to worry about. You can email bank statements / document scans to them, and this is perfect if you are able to do so - it gets them the information they need very quickly, so they can get you processed as fast as possible ;)

As for 2.5 hours, mine took just under an hour. Pretty much all this time is spent going through all the info you've already entered on the SoA forms you took to the Court (so be sure to have a copy of this form handy!)

    Good luck :)

Thank you very much, I'm sure it's an ordeal that is not worth the fuss when one has hindsight?
