Being sued for someone else's gas!

  • I'm sorry - I assumed from your initial post that you had a screenshot of your current property. It appears you have one that shows the incorrect flat - that should be good enough anyway, as you can easily prove you don't live there, and it is therefore nothing to do with you.

    Have you tried emailing Xoserve with details of what you want to take to court, explaining that they are your last resort as the suppliers, COOP, SSE and Utilities Warehouse refuse to help? Externalrequests.spa@xoserve.com

    I would just reiterate the advice you have already been given. Turn up in court with the evidence you do have i.e. of your address, photos of meters with serial numberings showing and old bills. Also take copies of your correspondence and summaries of your telephone calls.

    As already said the magistrate will not grant a warrant if there is any material doubt. I suspect the supplier will withdraw the application when they see you have turned up.

    So, there has been a to and fro of emails between me and Utility Warehouse. Today I was told that the court thing coming up on Monday isn't a hearing and implied it was just a bureaucratic thing and it wasn't much point in my going.

    They also said that I could go to the Ombudsman if I liked but they wouldn't take my case!

    It is already with the Ombudsman, (but Utility Warehouse refuse to suspend the matter while the Ombudsman deals with it), I have a case number, and I have even sent the case number to Utility Warehouse. Yet they are claiming I won't be able to.

    I can't help wondering if I am dealing with a loony so I am going to try to get in contact with someone else at the company in the hopes they may talk some sense.

    I have found out the home address of the head of the board of directors. Would it be a good idea to write to him directly?

    Absolutely attend court and demonstrate what cretins they are.

    Have you got the paperwork from the court ie is it real ? I'd ring the court (if no paperwork) and if it's listed, I'd absolutely attend, armed with every shred of paperwork to prove they don't and never have supplied your gas.


    Btw, they have probably trashed your credit file by now. Unpaid bills passed to bailiffs .......

    How on earth have you found out their home address? Do not under any circumstances contact him at home. That could easily be construed as harassment.

    Who told you what exactly and is it in writing? I would be extremely wary of relying on this information unless I had it clearly in writing from the court. (I read another thread on another forum where a customer was told at the court by the other side that the case had been cancelled. They then went home and lost the case by default.)

    What exactly did they say was the purpose of this "bureaucratic thing"? There will be a purpose, and if it is not to get a warrant what is it for? If it is going to court I strongly suspect it will be to get a warrant.

    My view is you should get to the court early and find out who you need to speak to. Don't worry about being seen to be a bit or a nuisance, and don't be intimidated by the court officials.

    There is no crime in writing directly to the director. What you need to consider is whether you are more or less likely to be helped by the company if you write directly to a board director. (I don't know the answer, I suspect it will depend on the director's personality.)

    They are not personally liable as a director for a limited companies debts or actions. The OP has no business contacting them through non-business channels. You say it's not a crime - grey area. It is certainly a truly dreadful idea.

    No-one was suggesting the director was personally liable for any company debt. I don't even think the matter concerns company debt.

    The director may well say the OP should not write to him at his home. However there is certainly no law stopping the OP doing so. (Unless the OP was planning to threaten the director.)

    Of course it is not a crime and is not even remotely in a grey area. The suggestion it is a crime is absolutely ridiculous.

    However I think it could well be counterproductive as it may cause the company to be less rather than more helpful.
