Legal Advice

Dear All,

I am hoping that you will be able to assist. I'll try my best to cut a long story short....

I was demissed from a professional post by a local authority for gross misconduct. I fought the case and appealed but unfortunately this was upheld. Due to this I was referred to my registration body and the DBS and I had to undergo a 'fitness to practice' hearing. This has taken place and they decided that they were placing no restrictions on my practice. The panel also decided that the outcome also did not amount to misconduct and/or lack of competence. This means that the case is now closed and my status is unaffected.

This has gone on for 18 months and during this period of time other employers have been unwilling to take me on. It has caused a great deal of stress and I am wandering if I have a civil case to pursue?????????

Any advice or guidance would gratefully be received

    Your professional body will apply different standards to your employer, that does not mean your employer was wrong. Even if they were, you are well out of time for a tribunal claim. I can't see that there are any other paths for you to pursue.

    It's difficult to advise without knowing the source of the dismissal but ultimately, as TT has stated, it could be that the misconduct didn't cause harm to your professional role, but did so to your organisation.
  • You need to go and get proper legal advice I'm afraid.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked
