I took the br plunge!!

Hi All

Today I was made BR I thought id share what happened with all the ones currently thinking about it.
I went into my local county court on friday to be told that BR appointments are on a first come first served basis basicly they start at 10am and if you are not in the first five then come back another day. I got there early this morning and was seen at 10am. I didnt see a judge just a clerk she said in Lincolnshire the clerk goes through the form takes your money and when you walk out your BR the judges sign it off later that day you only need one copy of the form not three as the clerk says any alterations she makes wont be the same on the other forms. She then photocopies the form and gave me one copy back one for the court and one for the OR.. Twenty mins and I was out BR it was a relief. I got a call from the investigator for the OR he had a form to fill in and was asking loads of questions that were on the form I handed into the county court that morning I had the impression this guy might have been trying to trip me up but as I was not lying ..... He made an appointment to ring for the full interview on November the 5th and said he wanted to go into great detail about my creditors and the amounts I owe and why and was sending some more forms out to fill in which im to return after the interview along with lots of evidence he wants statements etc. One other thing he said was he will write to the cooperative bank about my cashminder account and say he has no intereast in it but he thinks the co-op will not allow me to keep it. Hey ho its done now and we will have to wait and see what he needs to know etc ive already told him ill cooperate in any way to make this as painless for me and him.

To those who contibute to this site id like to say thanks with out reading your posts it would have been much harder for me I suspect. A problem shared n all that .

  • Your cashminder account should be fine, you can always call their bankruptcy team tomorrow if you want confirmation :)
  • Hi all again this is an update for any that are thinking of the BR plunge!

Had my interview with the OR examinar on thursday morning we began by going through the statement of affairs form from the start. Things got a bit awkward when we started going through my debts he was asking questions about start dates no problem but breaking down of the amounts proved to be an issue as I as many others were encouraged to go paperless on most of my stuff and as Ive been frozen out of most of my online accounts anything over 12 months was difficult to explain The bloke was an expert at interagation a career in the gestapo has escaped him but to anyone thinking of going BR I have to say this he was only doing his job he is trying to discover if you have a secret swiss bank account or a luxury yacht bought out of your debts. That part over and having satified himself the reason I had gone BR he turned to the outgoings section and completely changed his tune and attitude.

Rent council tax tv licence he left alone but changed the rest This is for two adults and Two children.
    Food me £500 OR £528
Gas/elec me £134 OR £120 he said he had a government calculator for this
Telephone Me £20 OR £58 although he wouldnt later let me have a PAYG mobile sim this more than covers it.
    Clothing Me £120 OR £149
Internet Me £30 OR £30 my house phone and net is £47 per month so this is a win
    Haircuts £40 ok
    Child related expenses £20 ok
    Medical £40 ok
    Pets £15 ok
    Emergency £40 ok
Holiday fund Me £80 OR £60

All in all he budgeted more money thay I had asked for and I was given a £45 per month IPA to pay back which is nothing really considering the debt we were in I felt so relieved he could not have been fairer.

I didnt have to send any statements in just the three forms sent out to me a couple of weeks ago for data protection and tax etc. Three years living on a budget wont be a problem I wont see any quarterly budget payments though but to be fair we didnt see them anyway they were swallowed up by debt and now I actually have spare cash again. Once again thanks for all the advice I found on this site I hope this quick post will help others who find themselves in the situation I was in. :T
