Ex left me in debt

Hi! Im hoping someone out there can help me!

In 2008 my husband at the time took out a joint loan with The Black Horse, owing £6500.
I didnt know anything about this loan. In 2009 I left my husband it was a abusive relationship, we were divorced 2010.
In early 2010 out of the blue I received a letter from the county court telling me I owed this money, to cut a long story short I spoke to the black horse and their fraud dept as I denied all knowledge of the loan, they checked my signature with the original agreement (which he forged) letters went back and forth they told me I would still be chased for the debt and would be in touch in due course. He even spoke to them and told them that I didnt know anything about it, as I was paying back the other 25k he had left me with!! :(:(
My ex-husband is now deceased (2011)
Fast forward to 2015...I am looking to get a mortgage with my partner, i have got my credit reports from experian, equifax and callcredit. On all of these reports I was still financially assosiated with him so I wrote and they have taken him off my file.
The black horse loan is still on there (apart from the experian one) it says the default date was 2011. I dont have any county court judgements from it either?

How long with this haunt me for? I havent heard anything since early 2010 from them.

Will I have to pay it?

Will it ever be taken off my file? Can I put a note on my file to explain?

Will I get a mortgage? (my score is still high on all reports) however shows my debt amount as £6500. I have no other debts and actually score 999 on the experian report??

Apologies for the long post but I really dont know what to do and unsure if I should even get my hopes up of owning my own home. If you have any advise i would really appreciate it. :rotfl:

    All trace of the account will come off your credit report 6 years from the original recorded default date, so sometime in 2017 if the default is 2011.

    C'mon. let's get the story straight. Either the County Court handed down a judgement, making you responsible for the debt [which you say they did not]. Or the County Court forwarded you some papers with a complaint against you by someone else, and did not award a ccj against you.

    Getting this straight is fairly central to getting any useful answers.

    Your credit scores are meaningless. Experience, Equifax and Call Credit don't lend money so any score they assign to you is irrelevant.
  • When i spoke to them they said they would chase him for the debt as it was in his name but as I was listed as his spouse on the black horse paperwork they would be contacting me to pay the debt. I explained the situation to them and never heard any more. I dont have a ccj just on my credit report it says i have debt of £6500.

    Setting aside the CCJ issue for the time being, when was the last payment made to this loan, do you know ?


    In the circumstances you describe, Black horse appear to of backed off, but may still resurface, if they do, I would continue to dispute liability for the debt, do not admit any liability to them in any correspondence you may send them.


    There's a good chance you can get this over the statute barred line before any further action can be taken.

  • From what i can remember when i spoke to them early 2010 they hadnt recieved a payment since mid/early 2009.

    Do i just do nothing until if/when they contact me? As i said I havent spoken to them since early 2010. I didnt admit liability for it and i wouldnt accept that I knew anything or signed for the loan.

    He was a contractor and working away at the time so i didnt see any post about it either, by the time they had found out where he lived i had already left him hence why i didnt find out until 2010. They have my current address and phone number as I havent moved so have had the oppurtunity to contact me?

    Yes, wait until you receive something concrete, in writing.

    From what you say, its most likely statute barred, and that would be the way I would play it now.

    Its easier to prove SB, than it is to prove a fraud.

  • Thank you for your help! Im not planning on doing anything until they contact me im just worried how this is all going to effect me applying for a mortgage we have the deposit, no debt and are in a good position to buy apart from this hanging over me!
