Change of Circs, tax code and wage slips

I was made bankrupt in June. I spoke to my OR and it was agreed that my IPA would be NT Tax Code only. I have only just received my change of tax code letter and it says I will be on an NT Tax Code for the tax year April 15 to April 16. It says in my next wage I should get a rebate. I have been sending my wage slips to Clarke Willmott to prove I hadn't moved onto the new tax code yet. Do I pay Clarke Willmott the rebate?
Also the OR said due to my change of circumstances in September (we had a baby) she would send out a new Income and Expenditure form. This is fine but they are asking for my wife's payslips now. This never happened on the original I and E form and I just put what she contributed to the household. As it is my wife's pay has not been altered yet for her maternity pay this kicks in this month so past wage slips show her on her full wage. Which the OR doesn't know anyway.
Any help?

Hi Banquo21
Clarke Willmott will (or at least should) be anticipating that you will receive this rebate, so I expect that they will ask you for it soon enough.
The OR may have decided that they now want hard evidence of your wife's income, in order to confirm that your proportion of household expenditure does not leave you able to pay anything over and above a nil tax IPA. They could have sought this information back in June, but they are entitled to ask for it at a later stage of your bankruptcy.

What if my wife doesn't want to submit her payslips? So far I have kept her out of all this as the bankruptcy is in my name only.0

Hi again Banquo
The OR is an officer of the court and as such could ultimately compel third parties to provide information needed to help them carry out their functions. If they set an IPA up that you were unable to comply with, they could go to court to seek an Income Payments Order instead (rare but not unheard of).
It is important from your point of view that you demonstrate willingness to comply with the OR's requirements. This means at the very least showing them that you are endeavouring to persuade your wife to provide the payslips. If the OR feels you are not cooperating, they could potentially seek a Bankruptcy Restrictions Order against you and ultimately delay your discharge from bankruptcy.
It's important to stress the distinction between the OR's scope to seek info from relevant third parties, and those same third parties actually being "involved" in the bankruptcy or becoming liable in any way.

All the OR is trying to confirm is that your other half is paying her fair share of the bills. she won't be liable for anything. If she doesn't then the OR could then surmise that she can pay 50% of the. Ills and give you an IPA on this.
Just send in her last pay slip with a note that this is her last wage at this amount and her maternity pay starts on xx date and will be xx amount and you will happily supply the pay slip when she has it. Or don't send this current pay slip and write a letter to say she goes on maternity leave on xx date and you will send it as soon as you have it. They may or may not still ask for a current one but may be worth a try.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0 -
I have sent an email to the OR explaining the situation. More or less what you said Tigerfeet. I sent it this morning but had no reply yet.0

It's the weekend and then they'll be a backlog on Monday so give them some time.

They didn't need to see my wife's payslips. I didn't get a tax rebate just got to pay my NT IPA till April. No extra in the IPA as I don't have surplus income.
Would I right in thinking that when my Bankruptcy ends in June 2016 I won't have to worry about paying into an IPA?0 -
If there is no change in your circumstances between now and then you will not have to worry about an IPA at all.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0
