help needed with csa

hi there.to cut long story short my hubby pays csa for his son who is now 11.he found out a few days ago that his ex and her hubby along with his son are leaving the country the beginning of next year and moving to cyprus.
and we wondered where we stand on the csa side of things
will he stil pay even though their not in the country and shes not getting any money from our government??
any advice on this will be great thanks

I dont think that your husbandcan be made to pay maintainence via the csa if she moves abroad however this may apply only to new cases that are started when the pwc has meved. There is nothing to stop him making voluntary payments via the csa though. Kellogs will be along in a mo i'm sure to put you straight on that one

Does your husband have parental responsibility for his son? If so, to move your husbands son out of the country, they will need permission from your husband or it will be classed in the courts as abduction. (i had to apply via the courts for an order to move abroad with my son to live with my parents because my ex H had refused even though he had little interest or contact. I pdecided against moving as i was told that i would lose the case)

The CSA site has a list of reciprocal countries, and Cyprus is included.

REMO is all about maintenance orders via a court. As far as I'm aware, the CSA only has jurisdiction when both parents are resident in the UK (although there are some exceptions, such as servicemen).

So, as far as I'm aware, if the PWC moves abroad, the CSA case would close and the PWC would have to make a claim in Cyprus which could then be enforced in the UK under REMO.
