"Financial Association" Abuse???

Not sure what to make of this. Is it abuse by the credit reference agencies/consumer credit licence holders in question? Don't know. Doesn't seem right anyway.

My wife checked her credit file with all 3 Credit Reference Agencies this morning - Any credit card/personal loan application I've made over the past year we've been married is coming up with the financial organisation's name and "Association" next to it and the date the search was carried out.

My name isn't shown anywhere, but I know from the dates and the organisations involved that these are applications I've made - Just to be ABSOLUTELY clear, I have NEVER made a joint application for any finance, I have NEVER named her in any application - The only reference I have made to her is when asked my marital status, and I've clicked "Married".

The only joint financial arrangement we did have until yesterday when it was closed, was a joint bank account used for paying the monthly direct debits.

There is not and never has been any other joint financial arrangement or joint application for anything.

The mortgage is in her name. The application was in her name. The deeds are in her name. She paid all of the deposit for the house from her own funds.

My wife's sent a Notice of Dissociation to each organisation.

Have these financial organisations behaved improperly? Otherwise, how are they allowed to apparently crawl all over my wife's credit record leaving a trail behind them, when these area applications and accounts solely in my name?

Naturally we are married, so we are in that and only that capacity "financially associated" but that's it. There are no joint financial arrangements.

Is this likely to affect her liability for my debts during my bankruptcy as far as the OR is concerned?

Very grateful for any help from anyone who knows the answer.

    Sorry can't answer the CRA part of the qustion but as to the OR one, your wife will have no liability to your debts. They are not hers, she didn't sign anything and her name is not on the paperwork.

    The joint account would have created a financial association between your credit files, at least until it was closed yesterday. While that association was "live", any credit applications made by you would have seen the potential lenders take it into account, hence the searches carried out on your wife.


    Your wife has taken the right step by seeking the notice of disassociation. Going forward, this will mean she is assessed for credit purely on the basis of her own file.


    Happy to second tigerfeet2006's advice above as far as liability is concerned.
