UKCPS Ticket

sir/madam,


Received a letter through the post the other day stating I had to pay a fine for staying over a car park time limit. Apparently I was over by 11 minutes in Co-op car park when away on holiday. (£60 if settled within 28 days, £100 thereafter)


Did not believe this was a pay and display car park, certainly no ticket machines and I received no notice on my windscreen. The letter also looks very "makeshift", hence the research on this website.


Apologies, I am not being lazy, I have read a lot of research but the mass of information is confusing me on what I should do in my case.

    IPC member, so you should appeal it, this will be rejected, they may give an IAS appeal option, or not

    IAS appeals is a kangaroo court system, so you are likely to fail there too

    in which case its ignore for 6 years UNLESS you get court papers

    also complain to the coop and try for a cancellation

    the pay and display car park option you mention is irrelevant, its a private car park for a retailer (for customers) , this willl be time limited, hence the invoice for overstaying

    its not a fine, it wont even mention the word fine, it will say parking charge notice or something similar, so its an invoice, no private company will fine you

    This company appears to have a problem with v.a.t. If, as they claim, this is contractual charge, it is a fee for parking, and thus vatable.


    Have they accounted for vat on their paper work? If not it becomes a breach of contract. No vat is payable but it can only be sufficient to compensate them for losses arisingfrom the breach, i.e., no staff uniforms, N.I. contributions, no electricity, business rates etc., a GPEOL in fact. In many cases this loss amounts to nil.


    Ask them for a vat invoice. If they ignore your request, (which they probably will), it is a useful stick with which to beat them if it ever gets to court. You could fly argue ex turpis causa.
