JUST BEEN TO COURT YESTERDAY WITH WELCOME FINANCE/IND AND WON. In may 2013 IND started legal proceedings as they stated I owed with interest over £5000 from a loan that I took out in 2006.I knew that I didnt owe anything as I had made over £3000 in payments up to June 2008. I then became unemployed but I didnt worry because I had PPI. I didnt hear anything from any party until IND demanded payment in 2013. needless to say I told them to take a running jump. So they initiated court proceedings. I was glad because I wanted my day in court. but also worried.
When the court summons came I wrote my statement of defence, IND then had to reply to the court within a certain time period with a response to my defence.
They did not respond and the claim was struck out in sept 2013.
2 months ago I received papers from IND stating that they were applying to the court to have the case re-instated. This they wanted to do without a hearing.
However the court decided that a hearing to reinstate the case must take place, the date set was yesterday 7th oct. 1 week before the hearing IND sent me a witness statement to be read out at the hearing as they stated nobody would be representing them in person. A copy of the statement was also sent to the court.

  • When I arrived at court to my dismay there was a Barrister there to represent IND.
    Though I neednt of worried I didnt have to say any thing only to introduce myself to the Judge. I then watched as the Judge verbally tore the Barrister to bits destroying his arguments and points that he raised. He then apologised to the Judge saying he was only acting on instruction. The Judge made two Judgements. The claim was not to be re-instated. And the application of IND to have the struck out order lifted was also rejected and remains in place. I was awarded costs and expenses against IND.

    Even a barrister cant polish a trud if the case is a pile of !!!!

    yes my heart sank but I always knew I was in the right. I am just grateful to have had an excellent Judge.
