Advice please - been on a DMP for 6 years

Hi all,

I have been on a DMP for around 6 years and really want to try and clear this debt as soon as possible.

I was wondering if it is too late to send CCA Requests as i have been paying these debts for so long and acknowledge them? Or should i still request these with the thought that i may be able to request low F&F settlements if they can't provide them?

    You can request the CCA agreements at any point so it’s not too late. You could see what they come back with as it may help your case if you do decide to make F&F offers.

    I'm afraid not - i had a baby this year and if anything, my payments will have to decrease soon as i'm struggling to keep them as they are. My family have said that they may be able to offer some money if i can get F&F settlements but they cannot afford to pay the full amounts.

    If the debt companies cannot provide me with credit agreements where do I then stand? Do I still have to pay the debt? Or do I just use it as a better bargaining tool for f&f offers?

    If they don't supply anything, then the debt is unenforceable until they comply.

    They could comply by producing a reconstruction.

    But the point of the exercise is, for you, that it strengthens your hand when making an offer.
