Court. Please help

At the start of September I received court forms for a old credit card debt, I was expecting they would come. I filled them in accepting I owed the debt and offering them a monthly payment amount like it instructed me to do so on the forms. I sent them back a few days after I received them. This morning I have now received another form stating that I never sent the forms back and now they say I have to pay the whole amount back!
I really don't know what to do now, I have not got the money to pay the whole amount back.
What will happen next? will the bailiffs come round? Im really confused and stressed I did exactly what the court forms said to do, I don't understand!

Ring them as soon as you can - this is one of the very few occasions it's good to make contact by phone. The sooner you do it, the more likely they will believe you're not trying to avoid it. If you kept a copy, send it now. In future, always send back stuff by recorded delivery and keep a copy.

Dirty trick commonly used. They tell the court you didnt reply to get a judgement in default. Ring the court and ask them what to do as the claimant did not pass the forms on to the court as they should have.

The forms needed to have been sent to the 'Address for Sending Documents and Payments' that is specified on the Particulars of Claim form. If you did this within the time scale then the claimant should have forwarded them on....unfortunately, if your forms weren't sent recorded delivery then it may be hard to prove what you did.

If you do now have a default judgement and can't contest the issue with your paperwork then I would suggest applying to the court to vary the judgement to instalments that you can afford. This is done on an N245 form and can cost £50. You can also request that any bailiffs are suspended with this form but that may not be necessary unless you have received notice of bailiff action (they must give you 7 days written notice before visiting).

  • I have emailed the court with the forms suggested, I have also emailed the company that the debt is from.
