working while suspended

hi all,
i have a problem at work, which i have just compounded with foolish behaviour.
i am suspended on full pay, after protecting myself when punched by a service user in support work.
i then went to work thro agency, which was not good!
I am wondering is it illegal to work while suspended in connection with safeguarding concerns and could it affect my dbs?
some people do stupid things....

    It is not illegal - but it could easily be gross misconduct. You are being paid to not attend work until the matter is resolved, not to work somewhere else until it is resolved. Doubly so if there are safeguarding implications.

    Unless there is a criminal activity involved, then it would not appear on a DBS - but things may be reported to a relevant regulatory body to appear on your record, or may be said in references.

    I doubt that you are suspended simply for defending yourself. So I must assume that you retaliated physically - and that is certainly an action which would result in suspension, and quite possibly in reporting if you cannot convince your employer that your reaction was appropriate.

    It would be infinitely easier to answer your questions if it was clear what "stupid things" you have done and whether the employer knows about them.
  • sangie, sorry some people write more clearly than others! I pushed him away from me to protect myself. such matters are micro-managed and deeply investigaed nowadays. most painful punch i've had in years - i responded instantly with a great deal of pain and a great deal of fear.
    the 'stupid' part is the working while suspended.

    OK - so your employer knows that you worked whilst suspended? Why did you do it? How did the employer find out? What were you working as?

    Have you received training in relation to violence from users? If you pushed him, did this result in injury, or falling or what?

    There is the potential that working for a second employer, without the permission of your main employer, whether suspended or not, could be classed as gross misconduct. It will be down to your contract of employment and your current employers attitude to your actions.

    OP states he is suspended on full pay.

    I suspect this suspension was not declared to the agency?

    So you've got two issues - working whilst you shouldn't be, and lying to the agency on a safeguarding issue. Are you sure care work is for you OP?

    That assumes that the OP was working in a role that required clearance (the OP didn't mention what the agency work was) and whether the agency actually asked - you can't lie to someone if they don't ask the question. But yes, there could be greater implications if the agency role was with a vulnerable group.
