Does anyone know how long it would be between issuing of a claim (small claim) and it getting to court IF there is a defence please
I am owed what to me is a lot of money and am looking at taking court action as there has been no response whatsoever to my letters, before that I tried phoning and texting but again no response. I just need to try and time things so that its not in the bad weather end December through January if its possible. Likely area is either Didcot or Barnsley depending on which address they are actually at now if that helps

If you start a claim now, any hearing could well fall in that period.

Have you done a letter before court claim?

You can start proceedings at 'the last known address' - that is perfectly OK.

In any event you can specify which dates you cannot make for a hearing.

Be aware though, that the defendant can have the hearing moved to a Court of their choice, so you may find yourself having to travel some distance if they want to be spitefull.

Thank you both. Yes I have sent 2 letters, the last was a before action and no response. I think I will just have to get on with it and hope the date is not too bad for me, and yes I have a feeling they will try to be as awkward as possible about it, but its not a sum I can dignore any more :(
