Working Hours in Lieu

Hi new to the forum hope someone can help.

My partner works for a popular supermarket. Every few weeks they will have a busy night where they require employees to stay extra hours. To avoid paying overtime they ask her to work less hours the week before and more hours this week. I know there's such a thing as time in lieu but it sounds fishy to me purely because on the time cards its saying she's working say 5 till 9 when in fact she's working 5 till 8. Then the following week she's working 5 till 10 but the timecard saya 5 till 9 still. I have no first hand experience of these rules so maybe someone can help. When I have looked up time in lieu it seems your meant to work normal extra hours first then get the time off. I.e time off your shifts but this doesn't seem to be happening on the timecards. Thanks

  • Just to confirm her timecard has fixed hours that don't change but she's being sent home early without timecards being changed and being told to owe hours to the company when they need her. Thanks

TOIL can work both ways in a flexi time system.

The important thing is what are the time cards recording, hours worked or hours to be paid?

If this is off normal company policy then I would want some written records of the hours worked and the local policy on flexi and being let off early to make up.

Not so important this way round but if they go to work the hours first(say over a long busy period like Xmas) and have the time off later you want a record you are owed.
