barclaycard - false debt!

hi

i got a letter from barclaycard claiming i owe them £4,000.00 pounds, i am outraged! and they are taking court action.....i have never had a barclays account!

has anyone else had this experience?

i wrote a stern letter to them telling them this, asking where they got my name and address from, i havent heard back from them yet.

where do they get off accusing innocent people of racking up £4,000.00 in debt!

    I'd definately get a credit report out on yourself, could anyone have got hold of your details?

    I'd expect a dodgy debt collection agency to get the wrong people (they send out several letters to people with the same name) but I wouldnt think Barclaycard would.

    Is the letter definately from them and not a collection agency? Also, if you never signed an agreement then they cant take you to court.
    Mummy to two girls, 4 & 1, been at home for four years, struggling to contend with the terrifying thought of returning to work.

    I would send a recorded delivery letter asking for a signed credit agreement, and stating that you do not acknowledge this debt.

    Someone will post a link to a letter soon im sure :)

  • Hi Mic,

    I too have received some correspondence from Buchanan Clark & Wells stating i owe them a £1000 for a barclaycard.I have never had a barclaycard in my life or even held a bank account with barclays.Fortunately due to the nature of my work i am fully aware of where i stand on a legal basis.
    The onus is on the creditor or collection agency to prove the fact that you are liable for the debt,it is not for you to prove that you don't owe the money.
    I would suggest as previously mentioned to get a copy of your credit file and also to approach barclays and to ask them to send the credit agreement and all documentation to you (which you have allegedly signed).I would advise you draft a letter to barclays stating you do not acknowledge the debt and you will not communicate with them until you have received all documentation and had a chance to look into this.
