Forced to take a company car

Hi my wife has recently been told as you drives more than 15k she has to take the option of a company car.
She currently has 3.5 years left of a Contract Hire car from BMW and obviously owning that car and the company car is not viable.
Can her company force her to take the company car? it is not in her contract and they knew she was hiring her own car and claiming the fuel allowance.
Any advise would be great!

Well, employers can and do alter terms of employment. There's just rules about how much notice they have to give.
You could look at it from the other side and ask: what if she'd lost her job instead of just being told she has to use their car? What was her exit plan in case that happened?
I'd not trust an employer further than I could throw them over anything that tied me financially to the job I had.... anything can end tomorrow.0 -
Your employer has the final word: get over it.0

We did consider this but as she has been employed with this company for over 18 years we though it a risk worth taking.
With regards the notice she was actually told verbally on the 10th that it had come into place on the 1st! and that for now she would have the reduced pence per mile and a monthly allowance but the company car will be forced in the very near future!0 -

thanks for that very helpful!!0 -
If you already have a hire agreement in place on a personal basis could that be renegotiated so the employer takes over the payments. Many of the big dealerships use the same companies for their fleet deals e.g. lex auto so it might be possible to transfer the owner. If you always do what you have always done, you will always get what you always got!0

thankyou that may be an option0 -
What about just taking the hit and only claiming for the 15k how much over is she?
or just do less business miles.
65 miles per day average on every work days is quite a bit unless the job is on the road.0 -

going to be between 80 and 100 miles a day but would still work out a lot cheaper than paying for a car to sit on the drive!! thankyou0 -
What did they tell her when she explained she had just entered in a personal hire contract? Just tough?0

pretty much! annoyingly when she took this new role 18 months ago they asked "do you want a company car or use your own" as then she owned a car outright she declined the CC, they even knew she was about to take a PCH 6 months ago.0
