LLoyds Loans interest

I know I have asked this or a similar question previously however I finally complained about the way the two loans were administered, the details are below, my question is now do I take it further and go to the Ombudsman.

In 2005 both my wife and I entered a DMP with CCCS (now step change) the two Lloyds loans we had (one each) were placed in temporary arrangements and sent to their collections department.

In August 2009 they contacted us, stating that the collections department was only a temporary measure and that the two loans would be passed onto their legal team and then onto a debt collecting company. I was about to leave the country so I asked for one more temporary agreement which would be for the length I was away. Which they agreed, however when I returned I tried to discuss the issue with them.

Eventually it was pushed to s debt collecting company and the interest stopped. Since then I have paid of in total my loan, however my wife still has an amount to pay.

I complained to Lloyds about the way the two loans were managed, we knew in June 2005 that the DMP was not a temporary measure, In the complaint I stated that the this and had the loans been passed to the debt collecting company the amount we would be paying would be less.

They have to their credit handled this quickly within 72 hours to be honest. They have stated that the rules have since changed and that as no admission of error aka a goodwill gesture they have refunded my wife £2.5K insurance and backdated the default notice on her credit file, which actually means it has been removed.

They have applied the same in principle to my loan, however as it is already paid they can not refund the interest, which means I have in theory overpaid £3K in interest.

I would like that amount to be applied to my wife's loans, which would leave us with £1.5K approx to pay.

Do I take this to the ombudsman or to I just take it on the chin?

    There is a case that they now owe you 3k in unfair interest charges, and on the face of it they are treating two identical cases differently. Now you have had Lloyds' final response you can ask the Ombudsman for their view. Don't be surprised if they find in Lloyds favour - I've always found them useless.

    I can't see any way that Lloyds will repay this money direct to a third party but there is NO reason why they can't pay it direct to you.

    You can always start a court claim after the FOS decision. But you can't ask the FOS after a court has ruled.
